By participating in any auction hosted on ThrowbackBuys.com (“TBB,” “we,” “our,” or “us”), you (“Bidder,” “you,” or “your”) agree to be bound by the following Auction Terms & Conditions (“Terms”). These Terms supplement and are in addition to TBB’s general Terms of Service and Privacy Policy. If there is a conflict between these Auction Terms and the general Terms of Service, these Auction Terms shall govern with respect to auction-related activities.
To participate in any TBB auction, you must:
Be at least 18 years of age or the age of majority in your jurisdiction;
Maintain a valid, active account on ThrowbackBuys.com;
Be an active ThrowbackClub member in good standing; and
Comply with all applicable federal, state, and local laws.
TBB reserves the right to refuse, suspend, or revoke bidding privileges at its sole discretion, without notice or liability, for any reason including but not limited to suspected violation of these Terms.
Participation in TBB auctions requires an active ThrowbackClub membership. By signing up for ThrowbackClub, you confirm that:
The account information you provided is accurate and complete;
You are authorized to use the payment method associated with your account; and
You understand that ThrowbackClub membership may be revoked at TBB's sole discretion for violation of these Terms.
TBB reserves the right to revoke any ThrowbackClub membership at its sole discretion, including but not limited to cases of non-payment, fraudulent activity, or violation of these Terms.
All bids placed in a TBB auction constitute binding offers to purchase the item at the bid amount, plus any applicable taxes, fees, and shipping costs. By placing a bid, you agree that:
Each bid is a legally binding commitment to purchase the item at the stated price if you are the winning bidder;
Bids may not be retracted, canceled, or modified once placed, except at TBB’s sole discretion;
You have reviewed the item listing, description, photos, and any stated condition notes prior to bidding; and
You accept the item in its described condition and acknowledge that all auction items are sold “as described” in the listing.
The highest bidder at the close of an auction shall be the winning bidder, subject to any applicable reserve price. Payment terms are as follows:
Payment is due immediately upon winning an auction;
If full payment is not settled within four (4) calendar days of the auction close, the winning bid shall be forfeited and the item will be offered to the next highest qualifying bidder;
This succession process will continue in descending bid order (second-place bidder, then third-place, and so on) until a bidder completes payment or no qualifying bidders remain;
Each successive bidder will receive notification and a new four (4) calendar day window to complete payment at their respective bid amount;
Payment must be made via an accepted payment method on ThrowbackBuys.com; and
The total amount due includes the winning bid amount, applicable sales tax, and shipping fees.
TBB reserves the right to send payment reminders, but the obligation to pay is not contingent upon receiving such reminders.
If a winning bidder fails to complete payment within the required timeframe, TBB may, at its sole discretion, take any or all of the following actions:
Forfeit the winning bid and offer the item to the next highest qualifying bidder per the succession process described in Section 4;
Permanently revoke the bidder's ThrowbackClub membership and ban the bidder from all future TBB auctions and purchases on ThrowbackBuys.com, effective immediately and without right to appeal;
Relist the item in a future auction or for direct sale; and
Pursue any legal remedies available, including but not limited to recovery of damages, lost fees, and costs associated with the non-payment.
Non-paying bidders may be reported to applicable third-party platforms and services.
TBB reserves the right to:
Set reserve prices on any auction item. If the reserve price is not met, TBB is not obligated to sell the item to the highest bidder;
Cancel, extend, pause, or modify any auction at any time and for any reason, including but not limited to technical issues, listing errors, suspected fraudulent activity, or insufficient participation;
Reject or void any bid that TBB reasonably believes to be fraudulent, erroneous, or placed in bad faith; and
Modify these Terms at any time, with continued participation in auctions constituting acceptance of the updated Terms.
In the event an auction is canceled, all bids for that auction shall be void and no bidder shall have any claim against TBB.
The following activities are strictly prohibited and may result in immediate account suspension, ThrowbackClub membership revocation, and/or legal action:
Shill bidding: placing bids on your own items or coordinating with others to artificially inflate prices;
Creating multiple accounts to circumvent bidding restrictions or bans;
Placing bids with no intention to pay (“ghost bidding”);
Bid manipulation, collusion, or any form of auction interference;
Providing false, misleading, or fraudulent account information;
Using automated systems, bots, or scripts to place bids; and
Any other conduct that TBB deems, in its sole discretion, to be disruptive, harmful, or contrary to the integrity of the auction process.
All auction items are sold “as described” in the listing. TBB makes reasonable efforts to accurately describe the condition of each item, including photos and written descriptions. By bidding, you acknowledge that:
Vintage and collectible items may show age-appropriate wear consistent with their era;
Minor variations between listing photos and the actual item do not constitute a material misrepresentation;
Shipping costs are the responsibility of the winning bidder and will be calculated at checkout; and
TBB’s standard shipping and return policies apply to auction purchases, except that auction sales are final and not eligible for return unless the item is materially different from the listing description, as determined by TBB in its sole discretion.
To the fullest extent permitted by applicable law:
TBB provides its auction platform on an “as is” and “as available” basis, without warranties of any kind, either express or implied;
TBB shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in any auction;
TBB's total liability for any claim arising from an auction shall not exceed the amount of the winning bid in question; and
TBB is not responsible for technical failures, internet disruptions, server errors, or any other issues beyond its reasonable control that may affect the auction process.
You agree to indemnify, defend, and hold harmless ThrowbackBuys, Inc., its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to your participation in any TBB auction, your breach of these Terms, or your violation of any applicable law.
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your participation in TBB auctions shall be resolved as follows:
The parties shall first attempt to resolve any dispute through good-faith informal negotiation for a period of thirty (30) days;
If informal resolution is unsuccessful, either party may initiate binding arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules;
Arbitration shall take place in Cook County, Illinois;
The arbitrator’s decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction; and
Each party shall bear its own costs and attorney’s fees, unless the arbitrator determines otherwise.
You agree that any dispute resolution proceedings will be conducted on an individual basis and not as a class action or other representative proceeding.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.
These Auction Terms & Conditions, together with TBB’s general Terms of Service and Privacy Policy, constitute the entire agreement between you and ThrowbackBuys, Inc. with respect to your participation in TBB auctions. No waiver of any provision shall be effective unless in writing and signed by TBB.
